BackgroundFew studies have identified the willingness rate of developing countries population to be enrolled in clinical trials.MethodsAll participants including patients, healthy volunteers and doctors completed a questionnaire to examine factors affecting the consent to participate in medical research.ResultsOverall, 80 % of the included population agree to participate in health research. This rate was lower for trials dealing with life-threatening diseases. Altruism and perceived risk of harm were the main reason to respectively accept or refuse to participate in clinical trials. Factors (...) significantly associated with willingness were: age <40 years 1.6 [95 % Confidence Interval 1.2-2.1]) and prior history of blood donation.ConclusionMost participants expressed their willingness to be included in medical research especially if they are young or if they have history of blood donation. Recent global efforts of the United States and England to withdraw from international institutions, along with recent challenges to human rights courts from Poland and Hungary, have been described as part of a growing global populist backlash against the liberal international order. Several scholars have even identified the recent threat of mass withdrawal of African states from the International Criminal Court (ICC) as part of this global populist backlash. Are the African challenges to the ICC part of a global populist (...) movement developing in Africa? More fundamentally, how are the African challenges to the ICC examples of populism, if at all? In this paper, I show that, while there is considerable overlap between the strategies used by particular African leaders to challenge the ICC and those typically considered populist, as well as a discernible thin populist ideology to sustain them, there is insufficient evidence of a larger anti-ICC populist movement in Africa. Although Africa is not as united against the ICC as the populist narrative suggests, the recent challenges to the Court from Africa pose a significant challenge to the Court, as the institution is still in the early stages of building its legitimacy. This study examines the impact of board gender diversity on financial misconduct. The findings suggest firms with gender-diverse boards commit fewer financial reporting mistakes and engage in less fraud. The findings hold after accounting for the potentially endogenous nature of board demographic characteristics via instrumental variable approach. Furthermore, the findings are consistent in pre- and post-regulation periods and hold for firms with good and bad governance. The findings do not seem driven by differences in effort or quality, in terms of (...) independence and expertise, of female and male directors. The benefit derived from increasing the number of female directors on corporate boards seems to diminish at higher levels of gender diversity, indicating that impact of gender diversity on decreasing the likelihood of financial misconduct may be a result of a change to board group dynamics. Two great challenges for reform of education have to be addressed if Muslim society is to respond meaningfully to the threat of terrorism.Most Muslims are strongly opposed to acts of violence, in any form, undertaken in the name of religion. Consequently, it hurts us to constantly see the name of Islam, ‘the religion of peace’, linked with international terrorism. Nevertheless, as Muslims we must face the reality that if we fail to address the challenges before us we will find ourselves (...) constantly confronted with accusations of harbouring terrorists - regardless of how fair those generalized accusations might be. If, however, we are prepared seriously to address these two challenges, people such as Osama Bin Laden will find increasingly little solace or support in Muslim society. (shrink)

This study revolves around the configurations of Dou Mbawa [People of Mbawa] in Bima, West Nusa Tenggara, eastern Indonesia, mapped onto the three main sociocultural-religious groups of Muslims, Christians and Parafu [followers of local beliefs]. It focuses on the Raju ritual as a ‘text’, representing social structures and dynamics of religious tension among the Dou Mbawa, which has been understudied in the existing works of literature. The central position of the Raju ritual is highlighted, as it is born from the (...) cosmological worldview and simultaneously practised by all three religious groups annually. Such interwoven ambiguities occurred in the life of the Dou Mbawa, involving ideology, authority and agents or actors, generating tension and confrontation that have led to Raju’s transformation from religious expression to cultural adaptation. Using ethnographic data generated from 2019 to 2020, this study argues that a Raju ritual is a political act that merely reflects the ideology of its supporters and shapes their capital bases and communicative actions to respond to social segregations.Contribution: This article shows how the Raju ritual promotes cohesiveness and harmony for a religiously diverse community by creating a shared ethnic identity and exercising it as a cultural adaptation. The demand of many scientific areas for the usage of fractional partial differential equations to explain their real-world systems has been broadly identified. The solutions may portray dynamical behaviors of various particles such as chemicals and cells. The desire of obtaining approximate solutions to treat these equations aims to overcome the mathematical complexity of modeling the relevant phenomena in nature. This research proposes a promising approximate-analytical scheme that is an accurate technique for solving a variety of noninteger partial differential equations. (...) The proposed strategy is based on approximating the derivative of fractional-order and reducing the problem to the corresponding partial differential equation. Afterwards, the approximating PDE is solved by using a separation-variables technique. The method can be simply applied to nonhomogeneous problems and is proficient to diminish the span of computational cost as well as achieving an approximate-analytical solution that is in excellent concurrence with the exact solution of the original problem. In addition and to demonstrate the efficiency of the method, it compares with two finite difference methods including a nonstandard finite difference method and standard finite difference technique, which are popular in the literature for solving engineering problems. Abraham Maslow (1943) suggested a framework [1] to study human motivation, which was a starting point towards developing the quality of life(QOL) theory. On that article, he described a hierarchy of human needs, that is generally consist of fundamental needs which are required for human survival, and environment dependent ones, like society, safety and etc. In this (...) study, we are trying to represent a tangible mathematical model for assessing the sense of need for water in terms of the available source of water. On this very subject, M. Joseph Sirgy [2] states that ”From a human developmental perspective, QOL goals can be defined as satisfaction of human developmental needs in a community or society”. Accordingly, in the first section we propose a model for the water needs of an individual. In the second section, we continue the discussion by checking the behavior of the model on a given population, and each time by assuming that we have two out of three involved factors, we try to suggest an estimation for the other one. Students’ Quality Circles (SQCs) are considered in the context of English Language Teaching in Pakistan, with a focus on oral expression. SQCs offer many educational benefits.

The coastal area of Bangladesh is one of the most ecologically productive and it contains a rich biodiversity which includes several species that are endemic to this region. Much attention has been focused on ship breaking industries in the coastal areas because of the threat they pose to this thriving biological communities along with their other environmental impacts and the perilous working environment of the workers. The coastal environment of Sitakunda is severely contaminated by various processes related to ship-breaking i.e. (...) the disposal of different toxic wastes into the sea water, deforestation by expanding ship breaking yard, changing land-use pattern and release of toxic substance into the soil. Moreover, the workers of this industry are exposed to an extremely risky and toxic working environment which makes them vulnerable to both physical and psychological disorder as well as to accidental deaths and injury. Still, workers embrace these risks for very poor wages and most of the profits go to the already rich businessmen. Despite various negativities, this industry has gained importance due to the increasing demand of raw material for re-rolling industries and employment opportunities for the people of the coastal areas. As this industry is indispensable due to its importance in the macro and micro economy of Bangladesh, a sustainable management approach should be taken to at least minimize the environmental and health impacts of ship breaking industries. The current paper aims to investigate the extent to which this industry is affecting the ship breaking yard labors and the environment, despite the growing concern nationally and internationally, and it uses both primary and secondary data. This article examines the “urang awak”, a term referring to the Minangnese who trace their origin to Minangkabau in West Sumatera, and their dakwah activism in diaspora. It problematises the relation of Islam activism and ethnic identity of a diasporic community in contemporary West-Java, Indonesia. It further argues that mosque has been central to the activities of dakwah activism of the urang awak in diaspora. As this article demonstrates, the Harakatul Jannah Mosque and Al-Anwar Mosque reserve as important bases for (...) dakwah activism of urang awak in a dominant culture of Sundanese and Javanese. Through these mosques, the urang awak attempt to preserve their ethnic identity, mainly expressed through the mosques’ architecture, language, and religious activities that clearly symbolise the identity of urang awak. In this article, I contribute to the debate between two philosophical traditions—the Kantian and the Aristotelian—on the requirements of criminal responsibility and the grounds for excuse by taking this debate to a new context: international criminal law. After laying out broadly Kantian and Aristotelian conceptions of criminal responsibility, I defend a quasi-Aristotelian conception, which affords a central role to moral development, and especially to the development of moral perception, for international criminal law. I show than an implication of this view (...) is that persons who are substantially and non-culpably limited in their capacity for ordinary moral perception warrant an excuse for engaging in unlawful conduct. I identify a particular set of conditions that trigger this excuse, and then I systematically examine it as applied to the controversial case of former-child-soldier-turned leader of the Lord’s Resistance Army, Dominic Ongwen, who is currently at trial at the International Criminal Court. This paper examines whether American parents legally violate their children’s privacy rights when they share embarrassing images of their children on social media without their children’s consent. My inquiry is motivated by recent reports that French authorities have warned French parents that they could face fines and imprisonment for such conduct, if their children sue them once their children turn 18. Where French privacy law is grounded in respect for dignity, thereby explaining the French concerns for parental “over-sharing,” I show (...) that there are three major legal roadblocks for such a case to succeed in US law. First, US privacy tort law largely only protects a person’s image where the person has a commercial interest in his or her image. Secondly, privacy tort laws are subject to constitutional constraints respecting the freedom of speech and press. Third, American courts are reluctant to erode parental authority, except in cases where extraordinary threats to children’s welfare exist. I argue that while existing privacy law in the US is inadequate to offer children legal remedy if their parents share their embarrassing images of them without their consent, the dignity-based concerns of the French should not be neglected. I consider a recent proposal to protect children’s privacy by extending to them the “right to be forgotten” online, but I identify problems in this proposal, and argue it is not a panacea to the over-sharing problem. I conclude by emphasizing our shared social responsibilities to protect children by teaching them about the importance of respecting one another’s privacy and dignity in the online context, and by setting examples as responsible users of internet technologies. This paper critically examines different formulations of the view that the crime of using child soldiers is less serious than other international crimes. The first formulation presents a sociological argument toward this conclusion and the second a deontological argument. After arguing that the second formulation is stronger, because it is grounded in a coherent ethical framework, I then construct a deontological argument to counter it, which construes the wrong of child soldiering as an attack on the developing child's right to (...) dignity, where dignity is understood through a Kantian lens as a person's moral agency. Background Moral distress is a major issue in intensive care units that requires immediate attention since it can cause nurses to burnout. Given the special conditions of patients in intensive care units and the importance of the mental health of nurses, the present study was designed to systematically review the factors affecting moral distress in nurses working in intensive care units. Methods PubMed, EMBASE, Web of Science, Scopus, and Science Direct were systematically searched for papers published between 2009 and 2019. (...) Original articles from quantitative and qualitative studies were reviewed. The CONSORT and STROBE checklists were used to assess the quality of the quantitative papers. The JBI checklist was applied for qualitative studies. Results Factors affecting moral distress in nurses include lack of nursing staff, nurses with inadequate experience, lack of support from organizations and colleagues, inadequate education and lack of knowledge of nurses, poor collaboration of physicians with nurses, ethical insensitivity and lack of teamwork, heavy workload, poor quality of care and moral violence and they are considered as risk factors for moral distress. Conclusion Many of the related causes are due to the nature of nurses’ work and it is necessary to manage the underlying conditions of this phenomenon so that it can be effectively prevented from spreading. Levels of moral distress require more attention of authorities in the use of prevention strategies and the reduction of effective factors in distress. (shrink)

Converging technologies require intelligent policy-making as they have significant capabilities to develop disruptive innovations. In this regard, future-oriented technology assessment is vital given the great uncertainty about the consequences of and barriers to accessing these technologies. However, few frameworks have been developed to evaluate converging technologies, and most of those have neglected the unique dimensions of these technologies. Therefore, this study aims to provide a policymaking framework for converging technology development. Accordingly, the proposed framework is designed through a meta-synthesis of (...) previous technology assessment frameworks by considering the feasibility, challenges, and achievements of converging technologies development pathways (CTDPs) as the key factors. Then, the framework is implemented in a case study of Iran and an appropriate strategy for each converging technologies development pathway is proposed based on a quadruple matrix of achievements and challenges. The results show that in Iran, biotechnology and cognitive technologies have the highest and lowest development horizons, respectively; and surprisingly, the combined field of biotechnology-cognitive is the most promising pair combination of converging technologies. We study the different solution strategy for solving epidemic model in different imprecise environment, that is, a Susceptible-Infected-Susceptible model in imprecise environment. The imprecise parameter is also taken as fuzzy and interval environment. Three different solution procedures for solving governing fuzzy differential equation, that is, fuzzy differential inclusion method, extension principle method, and fuzzy derivative approaches, are considered. The interval differential equation is also solved. The numerical results are discussed for all approaches in different imprecise environment.

BackgroundMeasuring the outcomes of palliative care plays an important role to improve the quality, efficiency, and availability of these services in patients with cancer. Using valid, reliable, and culturally appropriate tools has a considerable role to measure these outcomes. This study aimed to assess the psychometric properties of the translated version of the Palliative care Outcome Scale.MethodsThis methodological study was conducted in two outpatient clinics related to Shohada Tajrish and Baqiyatallah hospitals in Tehran in 2019–2020. The translation was done using (...) the Forward-Backward approach after gaining permission from the developer. Face validity was tested with 10 patients with cancer through cognitive interviewing, as well as content validity with four experts. Construct validity was performed by exploratory factor analysis and confirmation. To assess the reliability, internal consistency was assessed by using Cronbach's alpha coefficient, and relative stability was assessed using the interclass correlation coefficient. Furthermore, interpretability and ceiling and floor effects were assessed.ResultsA total of 353 patients with cancer under palliative care were included in the study. Then, three psychological, physical, and social factors with a cumulative variance of 54.34% were extracted in exploratory factor analysis. Confirmatory factor analysis showed that the model has a good fit of information. Cronbach's alpha coefficient for scale was 0.719. Furthermore, the ICC was 0.812. The scale was interpretable, and ceiling and floor effects were 0%.ConclusionPersian version of the POS was evaluated as a valid and reliable tool. Therefore, it can be used by the clinician to monitor the consequences of palliative care in Iranian cancer patients. (shrink)

This study investigates structural influence of the Madrassah system on effectiveness of its students in terms of civic health, system thinking and professional development. The researchers constructed the instrument of survey after rigorous literature review, frequent interaction with scholars, clerics and policy makers. The survey was administrated to 600 Madrassah’s students from different schools of thought. By applying T-test and Kruskal Waliss Rank Test for measurement of effectiveness and Structural Equation Modeling methodology the researchers has explored the relationship between the (...) variables, and later analyzed with the help of selected model. Findings of the study demonstrate that education system followed in Madrassahs does not seem to be effective and need-based in contemporary times. Indicators of Madrassah structure such as curriculum and openness negatively influences the students while peda­gogy positively influences the effectiveness of students of Madrasah in Pakistan. In the end, it is recommended that curriculum and pedagogy of Madrassah should be reformed and updated in accordance with knowledge-based economy. This will not only upgrade the poor segment of society but also bring together the variety of individuals close enough to understand each other. (shrink)

The belief system of academicians has an impact on how religious education (RE) is carried out in public universities. The ideology of RE lecturers - whether it is moderate, radical, or liberal - is greatly influenced by their own religious beliefs. The purpose of this study was to explore the relationship between religious paradigm of religious education lecturers on interreligious tolerance and pluralism in public universities in Indonesia. The study sample comprised 142 lecturers drawn from ten public universities in Indonesia. (...) A mixed method research design guided this study, where qualitative data was used to reinforce or clarify the findings from the quantitative data. The data was statistically assessed using the nonparametric Mann-Whitney U-test to reveal whether the demographic profiles of RE lecturers was related to their religious paradigm regarding the relationship between religion-state, inter-religious relations and intra-religious relations. The study's findings indicate that the lecturer's personal beliefs about religion affect their opinions on the relationship between the state and religion, as well as the relationships within religious groups. Moreover, religious educators have a middling level of comprehension of their religious paradigm. To promote understanding and harmony among the academic community, it is suggested that a platform for religious moderation be established at public colleges where educators and students of various religions can converse and resolve fundamentalism. De nombreuses sources antiques indiquent que l’épiclèse d’Apollon Smintheus, divinité honorée en Troade, provient du terme dialectal σμίνθος, qui désigne la souris. Des auteurs anciens ajoutent que des souris considérées comme sacrées sont élevées dans le sanctuaire. Or une nouvelle analyse de ces sources suggère qu’elles ne sont pas antérieures à l’époque hellénistique. Dans cet article sera proposée l’hypothèse d’une réinvention du culte du dieu à la suite de la découverte de l’étymologie supposée de l’épiclèse à cette époque. Dans un (...) second temps seront analysés les mythes permettant d’expliquer l’association d’Apollon et des souris. Il sera suggéré que le premier mythe a été créé par l’auteur d’une œuvre dédiée à l’histoire de la Troade et que son évolution reflète les préoccupations du sanctuaire et des deux cités auxquelles appartient successivement le lieu de culte. Enfin, une nouvelle interprétation de l’épiclèse du dieu sera proposée. (shrink)

Cette étude a pour objet la mention – très inhabituelle – d’images de « souris » parmi le tribut des Philistins accompagnant le retour de l’arche dans le récit de 1 Samuel 5-6. Sur la base d’une comparaison entre les principaux témoins anciens du texte de Samuel, on argumente ici que cette mention reflète une série d’interprétations successives, à l’intérieur desquelles on peut distinguer (au moins) trois étapes. À l’origine, la mention de souris semble relever d’une glose scribale, ayant pour (...) fonction de donner forme aux images de « tumeurs » apportées par les Philistins en tribut selon 1 Samuel 6. Plus tard, les images de souris ont été comprises comme formant un tribut distinct, ce qui a donné ensuite naissance à la tradition d’un fléau de souris dans le territoire philistin, tel qu’on le trouve raconté dans les principaux témoins grecs de 1 Samuel 5. Au terme de ce processus, les souris sont devenues un agent du dieu d’Israël, ce qui rapproche ce dernier de l’Apollon Smintheus. Les « souris » de 1 S 5-6 forment ainsi un objet textuel complexe, dont l’analyse demande de combiner une perspective philologique avec des considérations relevant plus franchement de l’histoire des religions. Résumé En 1880 fut créée au Collège de France une chaire d’Histoire des religions. Il s’agissait là d’un des moments forts de l’institutionnalisation de cette discipline en France. Il n’y eut pas alors d’élection, mais une nomination par le ministère. La presse rendit largement compte de l’affrontement entre les deux candidats. Jules Soury était alors le représentant d’un anticléricalisme virulent qui allait bien au-delà du catholicisme et qui affirmait que les religions étaient un archaïsme dont les sociétés évoluées finiraient par (...) se débarrasser. Le pasteur Albert Réville, qui l’emporta, était quant à lui le représentant du protestantisme libéral. On conserve aux Archives Nationales deux rapports défendant l’opportunité de cette création. L’un est de Jules Soury lui-même. Quant à l’autre, anonyme, nous pensons pouvoir l’attribuer à Ernest Renan. Nous publions ces deux textes inédits avec des notes explicatives. (shrink)

The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)

Haber-i vâhidin delil değeri problemi, 2. (8.) yüzyıldan itibaren kelamcılar (:Mutezile), fıkıhçılar ve hadisçiler arasında tartışılan ve hakkında kayda değer bir literatür ortaya çıkan usûlî konuların başında gelmektedir. Şeybânî (ö. 189/805), Şâfiî (ö. 204/820), İsâ b. Ebân (ö. 221/836) ve Buhârî (ö. 256/870) gibi sünnî ekolün tanınmış fıkıh ve hadis alimlerinin haber-i vâhid lehine ortaya koydukları çalışmalar bu noktada oldukça etkili olmuştur. Bu etkinin bir sonucu olarak başlangıçta haber-i vâhidi toptancı bir yaklaşımla reddeden Mutezili isimler, yerini zamanla Ebû Ali el-Cübbâî (...) (ö. 303/916) gibi başka bir delille desteklenmesi şartıyla kabul eden alimlere bırakmıştır. Cübbâî, muhtemelen Kitâbü’l-ahbâr isimli günümüze ulaşmayan çalışmasında, hem tek kişinin haberi anlamındaki haber-i vâhidin hücciyet delillerini tenkit etmiş hem de çeşitli delillerle kendi kişisel görüşünü temellendirmeye çalışmıştır. Onun bu tenkit ve görüşleri, 4. (10.) yüzyılın önemli Hanefi fakih ve usulcüsü Cessâs (ö. 370/981) tarafından usul ilminin kurucu metinlerinden el Fusûl’de üstü kapalı bir şekilde nakledilmiş ve eleştirel bir değerlendirmeye tabi tutulmuştur. Araştırmamızda Cübbâî’nin, haber-i vâhidin delil değeri, kabul şartları konusundaki eleştiri ve görüşleri ile Cessâs’ın ona verdiği cevaplar ve karşı eleştirileri ele alınmıştır. (shrink)

À partir d’une enquête de l’ethnologue Julie Delalande (2009) portant à la fois sur la pratique dans de nombreux pays de rituels liés à la perte des dents de lait et sur les croyances des élèves en France de la grande section de maternelle jusqu’en ce1, l’auteure propose d’analyser ce qui se joue entre les parents et l’enfant à travers le rituel et l’histoire de la « petite souris ». L’auteur postule que ceux-ci ont une fonction culturelle qui rend transitionnelle (...) l’expérience d’une perte pour l’enfant et qui lui permet de vivre des éprouvés de « merveilleuse inquiétante étrangeté » alors que la perte des dents de lait pourrait lui rappeler des angoisses archaïques de morcellement, des désirs cannibaliques, des angoisses de castration. L’analyse comparative des rituels selon les pays à propos de la chute des dents de lait permet de dégager ce qu’il y a de spécifique au rituel de la « petite souri s » : la question de la sublimation de l’analité en famille contre le retour d’angoisses archaïques et de castration. Deux ou trois articles récents, Nagel, Block, Jackson, forment la toile de fond de discussions actuelles au sujet des qualia et du caractère subjectif de l'expérience, du moins en philosophie de l'esprit. Ces articles ont ceci en commun qu'ils visent tous à montrer qu'un certain aspect de l'expérience consciente – les qualia ou sa dimension subjective – remet en cause l'une ou l'autre, ou l'ensemble de nos théories psychophysiques. Ce qui est visé, au-delà des théories psychophysiques, c'est le physicalisme, entendu (...) comme une théorie métaphysique portant sur l'ameublement de l'univers, comme l'affirmation que tout ce qui existe ce sont des objets physiques et des propriétés physiques ou des propriétés survenantes sur des propriétées physiqus. C'est pourquoi le point où l'attaque porte est le réductionnisme des théories qui affirment l'identité des états mentaux et des états physiques du cerveau. Peu importe la forme précise de ces théories, qu'elles affirment l'identité des éats mentaux individuels avec des états individuels du cerveau ou l'identité des types d'états mentaux avec des types d'états cérébraux, ou encore l'identité des états fonctionnels du cerveau avec les éetats mentaux, toutes sont censées trouver ici, dans deux ou trois expériences de pensée, leurs limites ou le sceau de leur échec.
